These General Terms and Conditions of Sale ("Terms") govern the sale of products through the website demiur.it (the "Website"). Please read them carefully before placing an order: by completing your purchase you confirm that you have read and accepted them.

2. SCOPE
These Terms apply to all purchases made on the Website by consumers, meaning individuals acting for purposes outside their trade, business or profession, as defined by Italian Legislative Decree 206/2005 (the "Consumer Code"). To place an order you must be at least 18 years old and provide accurate, complete information. Nothing in these Terms limits the rights granted to you by the mandatory consumer laws of your country of residence.
3. PRODUCTS
Every DEMIUR piece is designed by Luca Micco and crafted in Monferrato, Piedmont. We describe and photograph our products as accurately as possible; however, colours may look slightly different depending on your screen. Because our knitwear is made from natural fibres and partly finished by hand, small variations in texture, shade and measurements are a characteristic of each piece and not a defect. Please refer to the size guides and care instructions shown on each product page.
4. PRICES
Prices are shown automatically in the currency of your country. For deliveries within the European Union, prices include Italian VAT. Shipping costs are not included in the product price and are shown at checkout before you confirm your order; see our Shipping Policy.
For deliveries outside the European Union, prices are shown without EU VAT where applicable. Any customs duties, import taxes and brokerage fees charged in the destination country are paid by the customer and are collected directly by the courier.
When a promotion is shown, the reference price is the lowest price applied in the 30 days before the promotion, in line with Article 17-bis of the Consumer Code.
5. HOW THE CONTRACT IS FORMED
To buy a product, add it to your bag, go to checkout, enter your details, choose a shipping and payment method and click the final button to place your order. Before confirming, you can review and correct all the information you have entered.
After you place your order, you will receive an email acknowledging it. The contract is concluded when we send you the order confirmation email, which contains a summary of your order, these Terms and the information on your right of withdrawal. We may refuse or cancel an order in case of unavailability of the product, obvious pricing errors, or suspected fraud; in this case we will inform you and refund any amount already paid. The contract is concluded in English.
6. PAYMENT
We accept credit and debit cards (Visa, Mastercard, Maestro, American Express, UnionPay), Apple Pay, Google Pay, Shop Pay, PayPal, Klarna and Satispay, as detailed on our Payments page. Payments are processed securely by Shopify Payments and the respective providers; we never have access to your full card details. Payment is taken when your order is placed.
7. PRE-ORDER ITEMS
Products marked Pre-order are not yet in stock and are made for you after your order. Their estimated delivery time is 30 days from the date of your order. If an order contains both in-stock and pre-order items, it will be shipped in full once all items are ready, unless agreed otherwise with our Customer Care. If we are unable to deliver within the period indicated, we will contact you; you may agree to a new date or cancel the order and receive a full refund.
8. DELIVERY
We deliver only to the countries listed in our Shipping Policy. In-stock items are normally shipped within a few working days; delivery times are estimates and depend on the destination. In any case, in accordance with Article 61 of the Consumer Code, unless a different date has been indicated (such as for pre-order items), goods will be delivered no later than 30 days from the conclusion of the contract.
The risk of loss or damage passes to you when you, or a person you have nominated other than the courier, take physical possession of the goods. When you receive your parcel, please check that the packaging is intact; if it appears damaged, accept it with reservation or report the damage to the courier and to us as soon as possible.
9. RIGHT OF WITHDRAWAL
You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party you have indicated other than the courier, take physical possession of the goods (or of the last item, if your order is delivered in several parcels).
To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement sent by email to DEMiUR@demiurstudio.com before the withdrawal period has expired. You may use the model withdrawal form included in our Returns & Refunds Policy, but it is not mandatory.
Returning the goods. You must send back the goods to our atelier (Piazza Garibaldi 22, Moncalvo (AT), Italy) without undue delay and in any event no later than 14 days from the day on which you communicated your withdrawal. The direct cost of returning the goods is paid by you. Items must be returned unworn, unwashed, with their original labels and packaging. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
Refunds. We will refund all payments received from you, including the cost of standard delivery (not any extra cost for a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event within 14 days from the day we are informed of your decision to withdraw. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them, whichever is earlier. The refund will be made using the same payment method you used for the original transaction, at no cost to you. Customs duties and import taxes paid on deliveries outside the European Union are not refunded by us; you may be able to reclaim them from the relevant authorities or the courier.
Exceptions. In accordance with Article 59 of the Consumer Code, the right of withdrawal does not apply to goods made to the customer's specifications or clearly personalised, such as made-to-measure pieces created through our atelier service.
10. LEGAL GUARANTEE OF CONFORMITY
All products are covered by the legal guarantee of conformity provided by Articles 128 and following of the Consumer Code, which applies to any lack of conformity that becomes apparent within two years of delivery. If a product is not in conformity with the contract, you are entitled to have it brought into conformity by repair or replacement free of charge or, where this is not possible or proportionate, to a price reduction or to terminate the contract. To report a defect, contact us at DEMiUR@demiurstudio.com with your order number and, where possible, photographs. Normal wear and tear, natural pilling of fine fibres and damage caused by improper use or care not in line with the care label are not considered a lack of conformity.
11. REVIEWS
Product reviews published on the Website are collected through the Judge.me service. Review requests are sent only to customers who have purchased the product, and reviews from verified buyers are marked as such. We publish both positive and negative reviews, and we do not offer incentives in exchange for positive reviews.
12. LIABILITY
We are not liable for delays or failures caused by events beyond our reasonable control, such as strikes, natural disasters or courier disruption. Nothing in these Terms excludes or limits our liability where this is not permitted by law, including for death or personal injury caused by our negligence, fraud, or the rights granted to you as a consumer.
13. INTELLECTUAL PROPERTY
All content on the Website, including the DEMIUR name and logo, texts, photographs, graphics and designs, belongs to Nomad S.r.l.s. or its licensors and is protected by intellectual property laws. You may not copy, reproduce or use it for commercial purposes without our prior written consent.
14. PERSONAL DATA
We process your personal data in accordance with our Privacy Policy and our Cookie Policy.
15. COMPLAINTS AND DISPUTE RESOLUTION
For any complaint, please write to DEMiUR@demiurstudio.com: we will reply as soon as possible and in any case within 15 working days. You may also turn to an alternative dispute resolution (ADR) body under Articles 141 and following of the Consumer Code.
16. GOVERNING LAW AND JURISDICTION
These Terms are governed by Italian law, without prejudice to the more favourable mandatory provisions of the country where you have your habitual residence. For consumers resident in Italy, the court of the place of residence or domicile of the consumer has exclusive jurisdiction.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version published on the Website at the time of your order applies to that order.
